Welcome to 15/NOVE. These Terms of Use ("Terms") govern your access to and use of the 15/NOVE website, platform, and related services (collectively, the "Services") provided by 15/NOVE TECNOLOGIA E CONSULTORIA LTDA ("15/NOVE," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Definitions

  • "Platform" refers to the workflow automation software and related tools provided by 15/NOVE.
  • "User" means any individual or entity that accesses or uses the Services.
  • "Subscription" refers to a paid plan that grants access to specific features of the Platform.
  • "Content" means any data, documents, workflows, or materials submitted or processed through the Platform.

2. Eligibility

By using our Services, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features of the Platform, you must complete the registration process. You agree to provide accurate, current, and complete information and to update it promptly when changes occur. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

4. Subscriptions and Billing

Subscription fees are billed in advance on a monthly or annual basis as selected during registration. Prices are listed in US dollars and do not include applicable taxes. We may change our fees with 30 days notice. Non-payment may result in suspension of access to the Platform.

All plans include a 14-day free trial. If you cancel during the trial period, no charges apply. For paid subscriptions, cancellation takes effect at the end of the current billing cycle.

5. Free Trial

We offer a 14-day free trial for new users. During the trial period, you have access to the features included in your selected plan. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial expiration.

6. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Services for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to any part of the Platform or its systems.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Reverse engineer, decompile, or disassemble any part of the Platform.
  • Upload or transmit viruses, malware, or malicious code.
  • Use the Services to send unsolicited communications (spam).

7. Intellectual Property

The Platform, including its code, design, documentation, and branding, is owned by 15/NOVE TECNOLOGIA E CONSULTORIA LTDA and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Platform during your subscription period.

Your Content remains your property. You grant us a license to process, store, and transmit your Content solely for the purpose of providing the Services. We do not claim ownership of your Content.

8. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the Brazilian Lei Geral de Proteção de Dados (LGPD). Both parties agree to comply with their respective obligations under data protection regulations.

9. Confidentiality

Each party agrees to keep confidential any proprietary information disclosed during the use of the Services. Confidential information shall not be disclosed to third parties without prior written consent, except as required by law.

10. Limitation of Liability

To the maximum extent permitted by law, 15/NOVE TECNOLOGIA E CONSULTORIA LTDA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim shall not exceed the amount you have paid us in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or secure. We reserve the right to modify, suspend, or discontinue any part of the Services with reasonable notice.

12. Termination

Either party may terminate these Terms at any time. We may terminate or suspend your access immediately if you violate these Terms. Upon termination, your access to the Platform will cease, and your Content will be deleted after 90 days unless otherwise required by law.

13. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes arising from these Terms shall be resolved in the courts of Sao Paulo, SP, Brazil.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Platform. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
